SERVICES
GeneralUnless otherwise noted, photographs will be taken using digital camera equipment, producing digital images in high-resolution JPG format. Photographer will use her professional judgment to determine the final images to be presented to the Client and may include a mixture of colour, and black and white images. These edited images will be the only photos made available to the Client.

LIGHTSMITH IMAGES does not provide any unedited images to the CLIENT as it does not represent the quality LIGHTSMITH IMAGES strives for. LIGHTSMITH IMAGES takes pride in the edited images, and images will not be delivered if they do not meet LIGHTSMITH IMAGES’s quality standards. Whilst LIGHTSMITH IMAGES’s editing style is quite complimentary, please note below, what defines LIGHTSMITH IMAGES’s “edited” images. LIGHTSMITH IMAGES’s edited images include colour correction, colour enhancements, exposure correction, shadow and highlight recovery, lens correction, and a little artistic flare. LIGHTSMITH IMAGES’s edited images do not include retouched or photoshopped images. Please note, LIGHTSMITH IMAGES will may retouch photos within a collection. This is at LIGHTSMITH IMAGES’s own discretion whilst editing.

ResponsibilitiesAll involved parties agree to cooperate for the best possible results. Clients may provide, in advance, a list of desired photographs. While every attempt will be made to accomodate the CLIENTS desired list of photographs and to create the best images possible, no particular image is guaranteed. It is the responsibility of the CLIENT or designee to point out individuals/groups that are important to have photographed and to ensure that key individuals are available and prepared to be photographed. If the CLIENT or key individuals fail to appear at meeting place by scheduled time, they will not receive full time of shooting. 

COOPERATION
Unless otherwise noted, LIGHTSMITH IMAGES, it’s associates or employees will be the exclusive photographer(s) at the photography event and/or session. The CLIENT agrees that good faith cooperation and communication between them is important in obtaining a good result. The CLIENT must explicitly notify LIGHTSMITH IMAGES and photographer(s) in writing if they wish to have anything photographed in a particular way. LIGHTSMITH IMAGES or the photographer(s) will not be held accountable for not photographing desired portraits, if there is no one to assist in identifying these particular details and photographs on the day. LIGHTSMITH IMAGES is not responsible if key individuals fail to appear or cooperate during photography, or for missed images due to details not revealed to LIGHTSMITH IMAGES or beyond the photographer(s) control.

Photography coverage will depend on several factors, including participation of the CLIENT, weather, and other unforeseen circumstances outside the control of LIGHTSMITH IMAGES.

HOUSE RULES
CLIENTS agree and understand that the photographer(s) are limited by the guidelines of the location site/venue management/government rules and CLIENTS agree to accept the results that may occur from said guidelines. Negation with the officials/management for moderation of guidelines is solely the responsibility of the CLIENT. If the CLIENT appears under the influence of alcohol or drugs during the shoot, LIGHTSMITH IMAGES has the right to cancel the shoot immediately due to liability and health concerns arising.

USAGE
Copyright: It is understood that LIGHTSMITH IMAGES owns the copyright to all images. The CLIENT may not edit, adjust, scan, copy or reproduce images in any manner. The CLIENT also agrees not to supply images to any businesses or publications of any kind without the written permission of LIGHTSMITH IMAGES.

Licensing: Upon receipt of final images purchased by the CLIENT, the CLIENT is granted a print release to use digital images for non-commercial purposes such as printing, exchange with family and friends, or display on the internet.

Model Release: The CLIENT hereby grants to LIGHTSMITH IMAGES and successors, heirs, executors, administrators, assigns, attorneys, representatives and agents, the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT may be included, for editorial, trade, marketing, photographic competitions, advertising or any other purpose and in any manner or medium; to alter the same without restriction; and to copyright the same. The CLIENT hereby releases LIGHTSMITH IMAGES and all associates representatives and assigns from any and all claims, actions, demands, suits, liabilities, damages, expenses, and obligations of any kind arising from, or related in any manner to LIGHTSMITH IMAGES’ use of said images.

CANCELLATIONS & RESCHEDULING
Cancellation: In the event of cancellation, the deposit is NON-REFUNDABLE.

No Shows: LIGHTSMITH IMAGES is not responsible if the CLIENT and/or key individuals fail to appear during the photographic session or event, or for missed images due to details not revealed to LIGHTSMITH IMAGES. If the CLIENT and/or key individuals fail to appear at a scheduled session, any deposit is NON-REFUNDABLE.

Weather: If it is not possible for photography to take place at a specific location on the scheduled day due to weather, LIGHTSMITH IMAGES and the CLIENT may agree an additional session for an additional fee at the earliest date possible.

Force Majeure: In the unlikely event that the photographer(s) is unable to perform the duties stated in this Agreement for any unforeseen reasons or circumstances beyond the control of the Photographer, an attempt will be made to obtain the services of another professional photographer to fulfil the obligations of LIGHTSMITH IMAGES. If LIGHTSMITH IMAGES cannot provide another competent professional, all fees will be returned including the initial deposit.

Event: In the unlikely event that the photographer(s) is unable to perform the duties stated in this Agreement for any unforeseen reasons or circumstances beyond the control of the Photographer, an attempt will be made to obtain the services of another professional photographer to fulfil the obligations of LIGHTSMITH IMAGES. If LIGHTSMITH IMAGES cannot provide another competent professional, all fees will be returned including the initial deposit. LIGHTSMITH IMAGES cannot be held responsible for compromised coverage beyond her control such as, but not limited to, a guest’s camera flash, schedule conflicts, restrictions of the officiate or venue, weather conditions, or existing backgrounds and lighting conditions which may restrict the photography coverage and negatively impact the images.

Safety: The CLIENT has the right to refuse any pose or location. It is the responsibility of the CLIENT and/or guardian(s) of the CLIENT, to refuse to stand or be placed in any position or location where they feel uncomfortable or endangered. If the CLIENT and/or guardian(s) of the CLIENT, agree to stand or be placed in any position or location during the session, they assume all risks associated with the position and location. LIGHTSMITH IMAGES will not be responsible for any personal injury and/or property damage that might result from the CLIENT and/or guardian(s) being injured during a session.

Images: Entire liability for any theft, loss, injury or failure to deliver digital images, is limited to the return of any fees paid by the CLIENT under this contract. Once the images are delivered to the CLIENT, LIGHTSMITH IMAGES will archive the images for 7 years from date of delivery. After this date, LIGHTSMITH IMAGES will not permanently archive the images. It is the CLIENTS’ responsibility to back-up and protect the images.

Limitation on refunds: In the event the CLIENT is dissatisfied with the final results based solely on personal preference, LIGHTSMITH IMAGES will not offer refunds. Retakes will be offered for an additional, discounted price; however the CLIENT will receive images from the second session only.

Print Life: The CLIENT is aware that colour dyes and inks in prints may fade or discolour over time due to the inherent qualities of dyes and inks. LIGHTSMITH IMAGES will not be held liable for claims based upon the fading or discolouration of any images.

COMPLETION SCHEDULE

The CLIENT will be invited to a Design and Ordering Appointment within a specified time. All orders must be placed within a 5 day timeframe following Design and Ordering Appointment between LIGHTSMITH IMAGES and the CLIENT.  Delivery of final orders are subject to either payment in full or if a payment plan applies, a non-refundable deposit as agreed between LIGHTSMITH IMAGES and the CLIENT, along with approval of final art work by the CLIENT and turnaround times of preferred professional printing laboratory.

All photography products will be crafted and available for collection by the CLIENT within 21 days after payment in full or if a payment plan applies, payment of the non-refundable deposit as agreed between LIGHTSMITH IMAGES and the CLIENT.

Unless otherwise agreed upon, all images and products will be collected by the CLIENT in person from the premises of LIGHTSMITH IMAGES. Shipping costs may apply to those who request to have their order shipped.

Weddings

Coverage

LIGHTSMITH IMAGES will provide coverage for the dates, locations and hours specified in the WEDDING COUPLE QUESTIONNAIRE. LIGHTSMITH IMAGES may use additional assistants. LIGHTSMITH IMAGES and assistant(s) are entitled to a 30 minute break during the reception while guests are dining. This time is included in the hours specified. To ensure LIGHTSMITH IMAGES has enough time to take photographs discussed and to acquire group and couple shots, the CLIENT must provide at least 1 hour slot after the ceremony. Videographers, vendors, and guests must not interfere with the official photography. These individuals are not permitted to take any still shots during formal sessions. Wedding guests may take photos, however, it is the responsibility of the CLIENT to ensure they don’t interfere with the duties of the Photographer. The CLIENT agreed to confirm the schedule one week prior to the event. If any changes arise in the schedule or location, the CLIENT must notify LIGHTSMITH IMAGES in a timely manner, by email for documentation. LIGHTSMITH IMAGES will acknowledge changes and the CLIENT must obtain confirmation of receipt.

Deposit + Payment Schedule

Mandatory Deposit: A non-refundable deposit of {{payment_schedule.retainer}} is due at the signing of this agreement. This is a NON-REFUNDABLE RETAINER.

Balance on Wedding Photography Collection: All balances are payable 28 days prior to the scheduled event and must be paid in full.

Payment Schedule on Print and Album Orders purchased in addition to Wedding Photography Collection: 

Full Payment: Full payments are non-refundable, but may be exchanged for credit or different product choices within 72 hours of payment.

Payment Plans: Orders require a non-refundable deposit, as determined during your Design and Ordering Appointment. Products will be ordered at the commencement of the payment plan. The payment plan is a legal, binding agreement to the agreed total. As products are customised, no refunds or returns are accepted. Any delayed/failed payments will incur an $11.90 fee. If more than two consecutive payments are missed, then debt collection through a third party will be enacted. All products covered by a payment plan remain the property of LIGHTSMITH IMAGES until the payment plan has been completed. As such, LIGHTSMITH IMAGES retains the right to retrieve the products by any and all means necessary after 3 consecutive failed payments.

Extras: If extras are added on the day of the photo shoot, payments must be paid before the images are handed over to CLIENTS, approximately 2-4 weeks after the event.

Other Services: Additional prints and products outside the purchased photography collection are available as a separate order. Prices are subject to change at any time.

Completion Schedule

The CLIENT will be invited to a Design and Ordering Appointment within 6 weeks after the wedding day. All orders must be placed within a 5 day timeframe following Design and Ordering Appointment between LIGHTSMITH IMAGES and the CLIENT.  Delivery of final orders are subject to either payment in full or if a payment plan applies, a non-refundable deposit as agreed between LIGHTSMITH IMAGES and the CLIENT, along with approval of final art work by the CLIENT and turnaround times of preferred professional printing laboratory.
